Welcome to the Nuance Customer Forums. These forums are here to provide Nuance’s customers and partners with a collaborative environment within which to discuss Nuance’s technology and products, to exchange ideas about them, and to learn from one another.

 

In order to promote an informative and constructive dialog, Nuance sets out these Terms of Use so that all users will understand what are the appropriate and prohibited uses of the Nuance Customer Forums. These terms are not exhaustive, and Nuance reserves the right to modify them at any time, effective upon notice of the modified terms on the Nuance Customer Forums. By registering as a user or using the Nuance Customer Forums, you agree to abide by these terms as modified from time to time. Nuance also reserves the right to address any conduct on the Nuance Customer Forums that in its discretion is deemed inappropriate on a case-by-case basis, and any violation of these terms may result in the suspension or termination of your right to access the forums.

 

Nuance Forum Moderators

 

The Nuance Customer Forum is moderated by designated Nuance Forum Moderators. These Nuance Forum Moderators may provide answers to some questions; however, these forums are not a substitute for contacting Nuance Technical Support or Customer Service. Nuance will not be responsible for any content or conduct provided by non-Nuance employees or by Nuance employees who are not Nuance Forum Moderators.

 

Links to Third Party Sites

 

You are permitted to post hypertext links to content hosted and maintained by third parties. Posting such links will be subject to these Terms of Use. The third party sites are not moderated by Nuance, are not under Nuance’s control, and your access to any linked site is at your own risk. You should use your own judgment before you use any link or access any linked site. When leaving the forums using any link provided by a user, you should be aware that Nuance’s terms and policies no longer govern, and, therefore, you should review the applicable terms and policies, including privacy and data gathering practices, of that site. Nuance makes no claim or representation regarding, and accepts no responsibility for, the quality, content, nature, or reliability of sites accessible by hyperlink from the forums. The ability to include links is provided only as a convenience to you, and the inclusion of any link by a user of the forums does not imply affiliation, endorsement, or adoption by Nuance of the linked site or any information contained therein.

 

Rules of Conduct

 

Users of the Nuance Customer Forums is limited to persons aged 13 and over. By participating in the Nuance Customer Forums, including by posting content, you agree that you will not upload, post, or otherwise transmit any content (including text, links, communications, software, images, sounds, data, or other information) that:

 

a.                   Is not consistent with the appropriate uses outlined by these Terms of Use, including, but not limited to, content that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another’s privacy, vulgar, profane, sexually explicit, obscene, racially or ethnically offensive, or otherwise objectionable;

b.                   Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party;

c.                   Constitutes advertising or promotion, junk mail, “spamming,” chain letters, or any other form of unauthorized solicitation;

d.                   Contains software viruses, Trojan horses, worms, time bombs, or any other computer code or files that are designed to disrupt, damage, or limit the functioning of any software or hardware;

e.                   Impersonates any person or entity, including a Nuance employee

f.                     Attacks or insults another Nuance Customer Forum user or moderator;

g.                   Suggests or encourages illegal activity; or

h.                   Violates United States export laws or regulations.

 

Personal and Confidential Information

 

These forums will be accessed by other users and third parties. Do not reveal information that is personal, confidential, proprietary, or that otherwise you would not want to make public. Anything you post in the forums, you post at your own risk.

 

Disclaimer of Warranties and Limitation of Liability

 

Most of the content posted to the Nuance Customer Forums is provided by third parties such as you and other users. Such third-party content is the sole responsibility of the person originating that content. Nuance does not control, and is not responsible for, this third-party content. You agree to indemnify and hold Nuance, and its subsidiaries, affiliates, officers, agents, and employees harmless from any claim, including reasonable attorneys’ fees, made by any third party due to or arising out of content you submit, post, transmit or make available through the Nuance Customer Forums, your use of the Forum, your violation of these Terms of Service, or your violation of the rights of another.

 

Nuance does not warrant or guarantee the accuracy, reliability, completeness, usefulness, non-infringement of intellectual property rights, or quality of any content on the Nuance Customer Forums, regardless of who originates that content. You expressly understand and agree that you bear all risks associated with using or relying on that content. Nuance will not be liable or responsible in any way for any content posted on or linked from the Nuance Customer Forums, including, but not limited to, any errors or omissions in content, or for any losses or damage of any kind incurred as a result of the use of or reliance on any content.

 

Governing Law and Venue

 

Use of these forums and these Terms of Use shall be governed in accordance with the laws of the Commonwealth of Massachusetts, United States of America, without regard to its conflict of laws principles. You agree that any and all legal proceedings arising from your use of the Nuance Customer Forums shall be submitted to the state or federal courts in the Commonwealth of Massachusetts and that jurisdiction and venue are proper in such courts.
